Are Bannock County Court Records Public?

Yes. Members of the public have the right to access all records of proceedings according to I.C.A.R. 32. Access does not require any additional process. The inquirer simply needs to provide a search parameter, such as a name, filing date, or case number.

Notwithstanding, some Bannock County court proceedings are restricted. Examples of some Bannock County court records that are exempt from public disclosure include

Under I.C.A.R. 32, court records in different formats are made available to the public as long as the record is public. Inquirers can choose any of the options outlined below to retrieve a record:

Online

  • Channel: Idaho's judiciary offers statewide public access to case records through the iCourt Portal. Users can access cases at no cost as guests or registered users.
  • Search parameters: Researchers need to provide a name or a case number to retrieve the sought record. If an inquirer only knows part of the parameter, they can perform a wildcard search.
  • Steps to search: The inquirer only needs to visit the judiciary's webpage, click on "Cases and Opinions" at the top of the homepage, and follow the prompts.
  • Records available: Digital copies of case record summaries.
  • Availability of copies: Users can download a copy of part or all of the record.
  • Fees: Inspection of records and downloading through this channel are free.

In Person

  • Where to go: Inquirers can use the public computer kiosk available at the courthouse to search through the court records in the database. They can also submit a completed request form at the courthouse to inspect hard copies of a record.
  • Search parameters: Inquirers need to provide the name of a party involved in the case, a filing date, or a case number.
  • How to request a record: Requesters can submit a written request by providing as many identifying details as possible, or use the computer provided in the search area to find a record.
  • Fees: Inspection is free, while requesting a copy may incur a fee.

By Mail

  • Where to send the request: Requests can be forwarded directly to the court clerk's office.
  • Search parameters: The name of a party involved, case number, or filing date.
  • Fees/payment: This case inquiry method incurs a nominal fee.
  • Processing time: Typically, the result is sent to the inquirer within three days following the request. If the record is not found within this time, the requester is notified. As long as the record exists, it is typically provided within 10 days.

Fees for Court Records in Bannock County

There is no direct court or administrative rule regarding fees for court records in Bannock County or Idaho. However, under Idaho Public Records Law, Idaho Code § 74-102, which broadly categorizes court records, agencies must provide the first two hours of inspection and the first 100 pages of a record request at no cost. The custodian of a public record may assess a fee if the search exceeds two hours or the request exceeds 100 pages of copies. If the requested records contain nonpublic information that must be redacted, the clerk of the court may also charge a fee.

Criminal Records Access in Bannock County

These can be sent by mail or fax, or delivered in person to the Bureau of Criminal Investigation. Results are generally returned by mail after processing. Email requests are not processed.

Individuals can also opt for a fingerprint search. In this case, the requester would need to include a completed fingerprint card, the request form, the payment authorization form, the required fee, and other required information.

The procedure for requesting case records differs. Records maintained by the hearing court can be retrieved online, through iCourt, on-site at the clerk's office, and by mail.

Bannock County Probate Records

Probate records are created following a probate process. Probate is a legal proceeding hosted by the court where the estate or other property of a deceased individual is settled. Probate proceedings are handled through the Sixth Judicial District Court, particularly the Magistrate Court. Bannock County probate records are public.
